Voting Question: How do I file a defamation/slander suit and what do I ask for?
I have been having trouble over the past few years from one of my neighbors. Long story – I bought my home in a small lake community in rural Missouri 6 years ago. I am a hispanic single mom with 2 kids from Dallas Texas, we are the only non-white family in the community. When we moved we also brought along our new born pit bull puppy. Over the years we have lived here, this one neighbor has been harassing us by calling the cops on anything he can possibly think of most of which was nothing at all (grass was over 5 inches tall in places, my RV was blocking his view of the lake – from 2 houses away, I had too many cars in my driveway – my bf is a mechanic) now things are getting worse, last year someone tried to break into my house and left the sliding glass door open and my pit (indoor dog) got out (probably what scared the burglar away) so he jumped at the chance to call the police claiming vicious and aggressive animals were running the streets, this got my pit of 5yrs at the time shot, luckily she lived – and NO she is not mean in any way. Recently my new roommate let the dogs out in the back yard to get some sun so he called the cops because my dogs were loose in my own backyard (he said he was scared to mow his grass) they took them in and now they want to put them to sleep because it has become a problem. NOW this guy is going around telling the neighbors that I’m running a drug house. He even went as far as to tell a friend parked in my drive way that he was writing down all the cars license plate numbers and the times they arrive and leave so he can turn us in as a drug house, so I called the cops on him. They went to him and threatened to take him to jail if he stepped on my property again, so his new move is to go door to door to neighbor’s houses trying to get them to sign some petition stating that they think im running a drug house too, some have signed just based on his word. I dont know what to do anymore, I was told I could file a civil suit but I don’t know how or what to ask for. Can anyone help? This is getting ridiculous!
To the responder about the “dogs” and “cars” our puppy grew up and yes we did take in a 3 legged stray about 2 years ago so we had 2 dogs. We do have several cars, a truck, a van, & an rv, a car trailer, & the kids have 4 wheelers (this IS rural missouri & a lake property). But 4 adults & 2 children (myself, my 2 fem roomies and ones bf, & my 2 kids) live here, I drive 70 miles back & forth to work so I also have a backup vehicle, they are older cars (80’s and 90’s) that need work from time to time. They are all tagged, insured, & legal…. what I really need to know is what kind of lawyer handles this type of suit & second what am I asking for? I just want him to quit harassing my family & friends & to quit trying to get all my neighbors to hate me, if he would just take back what he said about us I would feel better. As it stands now, if my coworkers hear this(I work as an accountant at a school) & schoolmates(I also go to school full time) it could jepordize my integrity at work.

The Exterior Part Of The Home Inspection

When you’ve found and made an offer to buy a home, you will be given an opportunity to hire a home inspector to get the home checked out. At the home inspection the home inspector examine the exterior parts and visible structure of the home. There are seven exterior areas the home inspector will focus on.

1. Eaves and Trim – When looking at the eaves and trim, the home inspector probe for rotted wood. If permitted the home inspector will use a ladder to analyze the eaves and trim work for rotted wood. If the home inspector can’t, for height or landscape reasons, use a ladder they will usually use a pair of binoculars. If the home has gutters installed, the home inspector will inspect to see if they are clean and secured to the home.

2. Exterior Siding Material – The home inspector will analyze the exterior siding of the home and report on any defects in the wall covering. The home inspector will also provide the kind of material on the exterior walls. Commonly used materials are brick, vinyl, wood shake, and stucco.

3. Paint and Caulking – The home inspector will report on the general condition of the painted exterior areas like the siding, windows, doors, porches, etc. In addition, the caulking will also be examined around the doors and windows.

4. Windows and Doors – During the home inspection, the home inspector will report on the overall condition and any defects present, such as broken glass, in the home inspection report.

5. Window Screens and Storm Doors – If the home has storm doors, the home inspector will examine them to verify that they are functioning properly. Any missing or torn window screens will also be included in the home inspection report.

6. Porches, Decks, Patios, and Balconies – The home inspector will report on the condition of any porches, decks, patios, and balconies attached to the home. All defects are reported in the inspection report. Typical defects include problems with steps, railings, and wood to soil contact.

7. Additions – Many homes, particularly older ones, have had additional square footage added to them. The home inspector will comment on the connection of the main home and the addition and any defects that exist in the structure where the two sections meet.

Got An Offer On Your House… How To Judge The Offer?

So you decided to sell your home, you have picked the a real estate agent, and have listed your home. There have been several open houses and some interest and you have finally received an offer. How do you tell if this is a good offer or not? Of course, your agent will help in that department, but, remember, they are there to sell your home they don’t have any idea what will work for you and your family.

First thing to look at is the buyer’s financing. Are they able to get a loan or are they just hoping to qualify? The best case scenario would be that they are pre-approved which means that a bank/lender has taken a look at their income, credit, and down payment and has agreed that they would qualify for a certain amount of financing. This is a good indication that the loan will go through. Sometimes, the offer will not include that the loan is pre-approved, but if the buyer really wants the home, they will include a letter of pre-approval to help your selection along. As a buyer, you or your agent has the right to contact the bank and make sure the information presented is correct and that the bank has verified income, employment, and down payment funds.

Next,consider if the buyer has put down a substantial down payment. The larger amount, the better for the sale to go through. The more money the seller has invested in the contract, the less likely they will be to back out. It also shows how “heart felt” the buyer is on the property.

Be sure to look for special conditions within the contract that you cannot meet or control. For example :If a buyer must sell his home first before purchasing your home.This condition requires you to factor in other questions. Does he have any offers on his home now or any approved buyers? He does have his house listed with an agent, doesn’t he? If there are any clauses that you do not understand, you must clarify them in writing.

One other thing that you must realize in the real estate contract you will receive is there are dates and deadlines that must be reviewed. There is a certain rhythm for things to happen. For instance, there should be an inspection, appraisal, loan approval, and the closing date. These items should not have excessive time allotted to each by the buyer. For example, the closing date must allow time for the bank process to be completed including the underwriting, appraisal, and paperwork. The inspection date should be close to the contract date to allow time for any problems to be resolved quickly by the seller so the contract can be completed.

Any of the above mentioned items can void your contract. Be sure you understand all that is being asked of you, make sure the terms listed and set in all the documents make sense to you, before you complete the sale.

Ten Things To Repair Before Selling Your Home

Looking to sell your home but don’t know if you should make repairs first? Why not take the opportunity to impress your potential buyer and really wow them with the quality of your home. There are ten simple things you can fix that will leave a lasting impression on your prospective buyer.

1. Paint – A fresh coat of paint on the inside and out will do wonders for your home. Make sure that before you paint you make any repairs to the drywall or exterior wood. Take the opportunity the repair any damage before painting the home.

2. Floors – Have the carpet shampooed and be sure that any stains and odors are eliminated. Get any broken tiles or damaged floor boards repaired before the showing. Clean the grout lines in the tile to remove any mildew stains.

6. Go into the attic and be sure there are no leaks around the vent stacks, roof vents, chimneys and flashing. These are the most common areas where leaks occur. It’s better if you find these and fix them before the home inspector finds them.

7. Check to be sure all the exhaust fans for the bathrooms and kitchen vent to the exterior. Generally these items will be vented to through the roof or in some cases the they are vented through an exterior wall.

8. Make certain the sinks, plumbing, and faucets are not leaking. Check the caulking for gaps where the counter top and the wall meet.

9. Replace all the light bulbs and make sure the rooms are as bright as possible. Open the curtains to let as muck light in as possible.

10. Make certain the fireplace is clean and in working order. If your house has a gas log insert, show it off. Light the fireplace so your buyers can see how it works and looks in the room.

Relocating? Rent Before You Buy

Moving is a challenge even when you are just moving a few blocks. But relocating to a new city is one of the top five major life stresses and can be very nerve-racking, especially if you’re unfamiliar with the area.

One of the most difficult, but important decisions a home buyer makes when moving to a new area is selecting which neighborhood to live in. School system and average home price data is easy to find out, but what about the less tangible factors like walking distance to great restaurants and the quality of nearby public parks?

Home Inspections ” Inspecting The Roof

Now that you have found a home to buy, now it’s time to get it inspected. When the home inspector arrives at the property, one of the first things that will be inspected is the roof. There are seven areas of the roof he be looking at and reporting on.

1. Roof Style – Roof styles vary based on age of the home and the area the home is in. Many older homes have a gable style roof, while many newer homes have hip style roofs. A lot of time it depends on the area and the building practices used in the area. Some larger homes may have a combination of hip and gable depending on the design.

2. Roof Covering – The roof covering refers to the outer material that is installed over the roof sheathing. Types of roof covering include asphalt, wood shake, standing metal seam, slate, concrete tile, etc. Each component has an estimated lifespan and the inspector will likely estimate the remaining life of the roof provided proper maintenance is performed. This figure is only an estimate is usually based on the current condition of the material and the age of the roof.

3. Visible Flashing – The visible flashing is defined as the flashing material that is visible without having to remove the roof covering. Many times the flashing may not be visible. If it is not visible, the inspector will comment in the report that the flashing was not visible or not inspected.

4. Roof Penetrations – Plumbing sacks, gas vents, and roof vents are referred to as roof penetrations because a hole is cut through the roof to allow access to the exterior from the attic. These areas will have flashing or rubber boots around them to prevent roof leaking. Generally any leaking can be determined by the condition of the roof sheathing from inside the attic.

5. Chimneys – During the home inspection, the inspector will comment on whether or not a chimney is present. If the home has a chimney the inspector will examine the flashing and the height of the chimney to be sure it is in working order.

6. Skylights – The inspector will document if the home has skylights installed. If skylights have been installed, the inspector will determine if there is evidence of any roof leaks around the skylights.

7. Gutters and Downspouts – The inspector will comment as to if gutters and downspouts are installed on the home and if so are they are clean and secured properly.

Final Comments

Many inspectors inspect the roof from the ground with binoculars, from the eave with a ladder, or through a window in a dormer. Most insurance companies prohibit inspectors from walking on the roof due to liability reasons.
